FRACKVILLE — A Pottsville man charged with stealing weapons from a home in Girardville on Dec. 10 waived his right to a preliminary hearing before Magisterial District Judge Christina E. Hale.
Mark A. Smith, 28, of 717 Pinewood Circle, was charged by state police Trooper Michael Marinchak of the Frackville station with two felony counts each of theft and receiving stolen property and a misdemeanor offense of theft.
By waiving his right to a hearing Smith will now have to answer to all five charges in Schuylkill County Court.
Marinchak charged Smith with stealing a .22-caliber bolt-action rifle with a scope and a .22-caliber revolver owned by Harry Hart and Harry Baney.
Smith also stole about $142 in case and other items valued at $50, items owned by Hart, Marinchak said.

James R. Brown, 21, of 919 Ferdinand St., Scranton — withdrawn: burglary. Waived for court: criminal trespass and criminal mischief.

TREMONT — A Schuylkill Haven man is headed to Schuylkill County Court after waiving his right to a preliminary hearing Thursday on charges he was under the influence of a drug when he drove in December 2015 in Pine Grove.
Daniel Diaz-Walton, 19, of 103 Farm View Road, faces charges of driving under the influence, possession of a small amount of marijuana and disregarding traffic lanes. Magisterial District Judge David J. Rossi bound over those charges for court after Diaz-Walton waived his right to the hearing.
Prosecutors withdrew charges of speeding and careless driving.
State police at Reading alleged Diaz-Walton was DUI on Dec. 31, 2015, in Pine Grove.
Diaz-Walton is free on $5,000 unsecured bail pending further court proceedings.
