Criminal court, Feb. 29, 2016

In recent Schuylkill County Court action, Judge Cyrus Palmer Dolbin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Darlene M. Acor, 50, of Pottsville — two counts of delivery of a controlled substance; four to 23 months on house arrest with electronic monitoring, $200 in payments to the Substance Abuse Education Fund, $100 in payments to the Criminal Justice Enhancement Account, $226 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two counts each of possession with intent to deliver a controlled substance and possession of a controlled substance.

Francisco Aponte, 25, of Lansford — two counts of delivery of a controlled substance; six to 12 months in prison with immediate parole, $200 in SAEF payments, $100 in CJEA payments, $289 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two counts each of possession with intent to deliver a controlled substance, criminal use of a communication facility and possession of a controlled substance.

Neal E. Burgos-Lawson, 47, of Minersville — two counts of delivery of a controlled substance and one each of possession with intent to deliver a controlled substance, criminal use of a communication facility and possession of drug paraphernalia; three to 18 months on house arrest with electronic monitoring, $300 in SAEF payments, $150 in CJEA payments, $654 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two additional counts of possession with intent to deliver a controlled substance and three of possession of a controlled substance.

Jose F. Cabrera Jr., 24, of Pottsville — possession with intent to deliver a controlled substance; time served to 23 months in prison with immediate parole, $100 SAEF payment, $50 CJEA payment and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew a charge of possession of a controlled substance.

Michael V. Crowell, 57, of Lansford — theft by deception and tampering with records; six to 23 months in prison, $50 CJEA payment and $300 restitution, with sentence effective March 28. Prosecutors withdrew two counts of forgery, three of receiving stolen property and one of improper possession or use of documents.

David M. Dower, 29, of Shenandoah — possession of drug paraphernalia; one to six months in prison with immediate parole, $100 SAEF payment, $50 CJEA payment and $172 bench warrant fee.

Donald F. Fernandes III, 25, of Summit Hill — driving under the influence and improper tires; 48 hours to six months in prison, $525 in fines, $100 SAEF payment, $50 CJEA payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service, with sentence effective at 8 a.m. March 20. Prosecutors withdrew charges of driving without a license and careless driving.

Jarrid Finneran, 33, of Pottsville — delivery of a controlled substance; 18 to 36 months in a state correctional institution$50 CJEA payment, $2,162 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew a charge of conspiracy.

Ralph J. Gantz Jr., 52, of Pottsville — DUI; one to five years in prison, $1,500 fine, $300 SAEF payment, $50 CJEA payment, $3,868 restitution and 30 hours community service. Prosecutors withdrew charges of unauthorized use of a motor vehicle and failure to drive at a safe speed.

Lisa M. Gilbert, 44, of Cressona — DUI; 72 hours to six months in prison, $1,000 fine, $300 SAEF payment, $50 CJEA payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service.

Justin Haines, 28, of Shenandoah — possession with intent to deliver a controlled substance; 24 months in the intermediate punishment program.

All defendants who were sentenced must pay costs as a part of their sentences.
