A Zion Grove man is headed to state prison after being sentenced Monday in Schuylkill County Court.
Mark J. Schlauch, 26, must serve one to two years in a state correctional institution, Judge John E. Domalakes ruled.
Domalakes imposed the sentence after revoking Schlauch’s probation and parole, which the defendant admitted violating by committing new crimes.
Schlauch, who wore a prison jumpsuit, leg shackles, handcuffs and a belt during Monday’s hearing, originally pleaded guilty on June 2, 2015, to theft and unauthorized use of a motor vehicle. Prosecutors withdrew charges of conspiracy, access device fraud and driving under suspension.
At that time, Domalakes sentenced Schlauch to spend six to 16 months in prison, pay costs, a $200 fine, $50 to the Criminal Justice Enhancement Account and $5,679.31 restitution, all of which he still is obligated to pay under the terms of Monday’s sentence, and submit a DNA sample to law enforcement authorities.
State police at Frackville charged Schlauch with committing the theft on Nov. 16, 2014, in North Union Township.
In other recent county court activity, Judge Cyrus Palmer Dolbin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Steve Heredia, 22, of New York City; two counts of delivery of a controlled substance and one of possession with intent to deliver a controlled substance; six to 23 months in prison, $200 in payments to the Substance Abuse Education Fund, $100 in CJEA payments, $402 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew charges of conspiracy, possession of a controlled substance and possession of drug paraphernalia and an additional count of possession with intent to deliver a controlled substance.
Brian T. Ketterer, 48, of Lost Creek; driving under the influence and improper muffler; nine months to five years in prison, $1,525 in fines, $100 SAEF payment, $50 CJEA payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew charges of fleeing or eluding police and operating vehicle without valid inspection.
Terry D. King, 54, of Danville; theft; two to 12 months in prison, $50 CJEA payment, $195.60 bench warrant fee and $558.75 restitution. Prosecutors withdrew charges of access device fraud, theft by deception and receiving stolen property.
Sean F. Mackareth, 28, of Pottsville; possession with intent to deliver a controlled substance; 24 months in the intermediate punishment program, $50 CJEA payment, $113 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities.
Michael A. Martin, 37, of Millersburg; possession with intent to deliver a controlled substance, criminal use of a communication facility and possessing instrument of crime; six to 24 months in a state correctional institution, $100 SAEF payment, $50 CJEA payment, $680 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew five counts of possession of a controlled substance, an additional three counts of possession with intent to deliver a controlled substance, and one count each of prohibited possession of an offensive weapon and possession of drug paraphernalia.
Dustin J. Noecker, 25, of Landingville; burglary, criminal trespass and theft; sentencing deferred pending preparation of a presentence investigation. Prosecutors withdrew one additional count each of burglary, criminal trespass and theft and one count each of receiving stolen property, defiant trespass and driving under suspension.
Timothy J. Stephens, 28, of Ashland; criminal mischief; sentencing deferred until 11:15 a.m. March 22 pending preparation of a presentence investigation. Prosecutors withdrew one count each of arson and causing a catastrophe.
David M. Willis, 48, of Girardville; receiving stolen property; 30 days house arrest with electronic monitoring, 11 months probation and $50 CJEA payment. Prosecutors withdrew a charge of theft.
In other recent criminal court activity, a Pottsville man is headed to state prison after admitting Tuesday in Schuylkill County Court in three separate cases that he possessed two stolen vehicles and methamphetamine.
Michael J. Setlock Jr., 43, must serve 15 to 30 months in a state correctional institution, concurrent to his current sentence, Judge Cyrus Palmer Dolbin ruled.
Dolbin also sentenced Setlock to pay costs, $100 to the SAEF, $150 to the CJEA, a $50 bench warrant fee and $5,991 restitution, and submit a DNA sample to law enforcement authorities.
Setlock pleaded guilty to two charges of receiving stolen property and one each of possession of a controlled substance and disposition of vehicle with altered identification number. Prosecutors withdrew charges of possession with intent to deliver a controlled substance, possession of drug paraphernalia and improper display of plate or card.
In the first case, Blythe Township police charged Setlock with possessing a stolen 2001 Ford F-250 pickup truck on July 24, 2014, in the township.
In the other two cases, Pottsville police alleged Setlock possessed methamphetamine on July 29, 2014, and a stolen 1999 Jeep Cherokee on July 3, 2014. Each of those incidents occurred in the city, police said.
Also on Tuesday, Dolbin revoked the parole of Tawnya J. Bowman, 39, address not known, and recommitted her to prison. Bowman could remain in prison until June 29, 2017, and cannot apply for reparole until April 21.
Bowman admitted violating her parole by failing seven drug tests and not completing her drug and alcohol treatment.
She originally pleaded guilty on Nov. 12, 2014, to hindering apprehension, possession of drug paraphernalia, possession of a controlled substance and adulteration or misbranding of a controlled substance, with prosecutors withdrawing a charge of manufacture of a controlled substance.
Dolbin sentenced Bowman at that time to serve two to 23 months in prison, pay costs, a $100 SAEF payment, a $50 CJEA payment and $2,192 restitution to the state police crime laboratory in Bethlehem, and submit a DNA sample to law enforcement authorities.
Pine Grove police charged Bowman with committing her crimes on April 16, 2013, in the borough.
All defendants who were sentenced must pay costs as a part of their sentences.
