A Pottsville man will not have to spend additional time in prison after admitting Monday in Schuylkill County Court that he damaged a Schuylkill County Housing Authority residence while drunk in July 2013 in Schuylkill Haven.
Nathan B. Sites, 34, pleaded guilty to criminal mischief and public drunkenness, with prosecutors withdrawing a charge of criminal trespass.
Judge Cyrus Palmer Dolbin accepted the plea and, pursuant to an agreement between prosecutors and the defendant, sentenced Sites to time served to 12 months in prison with immediate parole.
Dolbin also sentenced Sites to pay costs, a $25 fine, $50 to the Criminal Justice Enhancement Account and $47.92 restitution to the authority.
Schuylkill Haven borough police charged Sites with damaging the wall or closet door of the house at 19 Fritz Reed Ave. on July 12, 2013.
Sites is an inmate at Berks County Prison, and Dolbin conducted the hearing by videoconference.
Also on Monday, Dolbin revoked the parole of John D. Butz, 36, of Pottsville, and ordered him recommitted to prison.
“It’s time for you to start taking responsibility” for his actions, Dolbin told Butz, who could remain behind bars until Nov. 9 and cannot be reparoled until at least May 18 except to an inpatient rehabilitation center.
Dolbin did so after Butz admitted violating his parole by failing to report to his supervising officer, using drugs, moving without permission, failing to complete rehabilitation and committing a new crime.
Butz originally pleaded guilty on July 24, 2013, to delivery of a controlled substance and possession of drug paraphernalia, with prosecutors withdrawing charges of possession with intent to deliver a controlled substance and possession of a controlled substance. At that time, Dolbin sentenced Butz to serve four to 23 months in prison, pay costs, $100 to the Substance Abuse Education Fund, a $50 CJEA payment and $113 restitution to the state police crime laboratory in Bethlehem, perform 30 hours community service and submit a DNA sample to law enforcement authorities.
Schuylkill County detectives charged Butz with delivering drugs on April 26, 2012.
Butz also must undergo drug and alcohol and mental health evaluations under the terms of Dolbin’s Monday order.
In other recent county court action, Judge Jacqueline L. Russell accepted guilty pleas from, and, pursuant to agreements between prosecutors and the defendants, imposed the indicated sentences on, these people:
Jeffrey M. Hartwell, 30, of Shamokin; driving under the influence; six months in the intermediate punishment program, $1,000 fine, $300 SAEF payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of stop sign violation.
Lauren A. Henn, 39, of Pottsville; DUI, possession of a small amount of marijuana, accident involving damage to attended vehicle or property and driving under suspension-DUI related; 90 days in prison, 12 months probation, $2,000 in fines, $100 SAEF payment, $100 in CJEA payments and $120 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of improper driving without lights.
Patrick Magrosky Jr., 24, of Auburn; theft and criminal mischief; 12 months probation, $25 fine, $50 CJEA payment and $50 restitution. Prosecutors withdrew charges of receiving stolen property, possession of drug paraphernalia and defiant trespass.
Donna L. Matthias, 37, of Frackville; three counts of possession of a controlled substance and one of possession of drug paraphernalia; 24 months probation, $300 in SAEF payments, $150 in CJEA payments and $226 restitution to the state police crime laboratory in Bethlehem. Prosecutors withdrew two counts each of delivery of a controlled substance and possession with intent to deliver a controlled substance and one of criminal use of a communication facility.
All defendants who were sentenced must pay costs as a part of their sentences.
